Uninsured Motorist Coverage: When The Other Driver Doesn’t Have Insurance
After being struck by a negligent driver, you can find yourself in a pretty frustrating situation as you try to make sense of what to do next. However, things can get all the worse if the person who caused your car accident does not have any useful insurance. What are you supposed to do now? Do you have your options, or will all of your recoveries have to come out of your own pocket?
IF YOU HAVE FULL COVERAGE
When you purchase a new insurance policy agreement, you might have noticed a part that asked you if you wanted to get full coverage, including uninsured motorist insurance. If you checked ‘yes’ and are paying an increased monthly premium for this coverage, you should be protected from situations just like this. But don’t get too hasty – you might have willingly purchased uninsured motorist insurance from your provider, but are they going to willingly cooperate? Sometimes in cases involving an uninsured motorist, especially if it was a hit-and-run accident, your own insurance carrier becomes your opposition as they try to give you the smallest amount possible.
IF YOU DO NOT HAVE FULL COVERAGE
If you are like most of us, you probably couldn’t pay the increased premiums for uninsured motorist coverage, or decided it was something that would never come in handy. Now that it is certainly useful, you don’t have it, so what do you do instead? You should first call the police and inform them that you have been struck by an uninsured motorist. This is a criminal violation (Transportation Code Chapter 708) that could cost them big fines paid to the state and, more importantly, take away their license for two years.
Secondly, just because someone has no car insurance doesn’t mean they have no liability for payments. You can sue them through a personal injury claim in civil court for your damages, and then some. Citing punitive damages, you may be able to collect a monetary compensation meant to make your life easier while simultaneously punishing them for their wrongdoing.
