But don’t get too hasty – you might have willingly purchased uninsured motorist insurance from your provider, but are they going to willingly cooperate? Sometimes in cases involving an uninsured motorist, especially if it was a hit-and-run accident, your own insurance carrier becomes your opposition as they try to give you the smallest amount possible.

Now that it is certainly useful, you don’t have it, so what do you do instead? You should first call the police and inform them that you have been struck by an uninsured motorist. This is a criminal violation (Transportation Code Chapter 708) that could cost them big fines paid to the state and, more importantly, take away their license for two years.

Secondly, just because someone has no car insurance doesn’t mean they have no liability for payments. You can sue them through a personal injury claim in civil court for your damages, and then some. Citing punitive damages, you may be able to collect a monetary compensation meant to make your life easier while simultaneously punishing them for their wrongdoing.
